In-Store Terms of Service 
I release and indemnify Pecos Valley Production and all its employees from criminal prosecution for any damages arising from using or possessing cannabis. 

  • I understand that becoming a Patient / Customer does not enter the Patient / Customer or Pecos Valley Production into a contractual relationship or entitle the Patient / Customer to a set or fixed price. Membership programs may be available, and all prices are subject to change.
  • I understand that Pecos Valley Production reserves the right to refuse service at any time for any reason.

 

Loyalty Points and Special Offers 
Moo Miles points and Moo Mile Offers are non-transferable, have no cash value, and can only be redeemed for eligible purchases at participating locations. 

  • Points are earned pre-tax, subject to availability, and expire after 90 days.
  • Participation is voluntary and can be revoked at any time.

Age Verification (Veriscan) 

  • I acknowledge that Pecos Valley Production may use physical and digital methods to verify the authenticity of any form of identification used to verify that I’m over the age of 21 for Recreational sales / 18 for medical sales.
  • I acknowledge that Pecos Valley Production follows all state laws regarding New Mexico ID Scanning regulations.
  • I acknowledge that Pecos Valley Production requires customers to have any valid ID card issued by a federal, state, or municipal government on hand. The card must contain a picture of the person, a birth date showing they are over 21 years of age, and an expiration date along with an issued date. It must also not be damaged and must be in a state that allows staff to confirm authenticity easily via digital and physical methods.

New Mexico NMDOH and CCD Regulations 
I agree to abide by the limitations of the use and possession of cannabis as set forth by the New Mexico Cannabis Control Division and the New Mexico Department of Health. 

  • I have read and understood the Lynn and Erin Compassionate Use Act and the Cannabis Regulation Act.
  • I confirm that I know the risks of using cannabis and agree to use it responsibly.
  • I understand that although cannabis is legal in New Mexico, I am not protected from federal prosecution.
  • I agree not to transport cannabis across the New Mexico border.
  • As per CCD regulations, I understand I am subject to full video and audio surveillance while in or around PVP’s property(ies).

 
 
Defective Products / Returns 
I understand and acknowledge that I must return edibles and select defective items within 72 hours of purchase. 

  • I understand and acknowledge that I must return defective BLOOM products within 30 days of purchase.
  • I acknowledge that I must have the original receipt and packaging when returning defective products.

I understand that Pecos Valley Production will do everything in its power to ensure the customer is satisfied with their purchase, but I acknowledge that all sales made at Pecos Valley Production are final, and no cash or credit-based refunds are available and or issued.

Online-Orders / Delivery 
I understand and acknowledge that pricing and THC% online is subject to accuracy. 

  • I acknowledge that Pecos Valley Production will not honor online pricing that does not reflect in-store pricing.
  • I understand that discounts, promos, and loyalty can not be stacked even if depicted online.
  • I understand and acknowledge that Pecos Valley Production has no control over third-party ordering platforms and what they do with the personal data collected by their systems.
  • I hereby release Pecos Valley Production and all its staff from any and all lawsuits that may arise from using third-party platforms/delivery services to place online orders for pick-up or delivery at any Pecos Valley Production location.

 

ACH Payments (Dutchie Pay) 
 
Dutchie Pay is an alternative payment company that allows customers to pay participating businesses through direct bank transfer (ACH).

  • ACH stands for Automated Clearing House, a U.S. financial network for electronic payments and money transfers.
  • ACH payments and direct bank transfers can move money from one bank account to another without using paper checks, credit card networks, wire transfers, or cash.
  • Using ACH and digital payment platforms, cannabis owners can leverage financial technology (FinTech) to help protect themselves from legal challenges, minimize costs, and increase operating efficiency.
  • These payment options offer unique features, including full integration, prepay, pre-authorization, and easy voiding/refunding.

Point of Banking Systems (PayRio) 

What is Point of Banking (POB)

Point of Banking (POB) allows you to pay for things using your debit card, just like when taking cash from an ATM. However, the money is directly sent to the merchant’s bank account instead of getting cash.  
  

These machines were created to help businesses that were considered high-risk, like medical marijuana dispensaries or those that mainly dealt with cash payments. Many companies, including amusement parks, bars, and farmer’s markets, use them. 
  

How Do Point of Banking (POB) Systems Work?

Point of banking (POB) are different from traditional ATMs that dispense cash. Instead, they work like the credit card machines that merchants use to process card payments. 

To use Point of Banking (POB), you insert your card and enter your PIN just like a regular ATM. However, instead of withdrawing cash, you choose an amount to “withdraw” in increments of $5, $10, or $20, and the machine prints a voucher to confirm the transaction.

The money you chose is then deposited into the merchant’s account, and you get a voucher to give to the merchant to show that you’ve paid. 

The Point of banking (POB) system works just like a regular ATM for getting specific amounts of money. However, you can only pay in specific amounts, and in most cases, the merchant will have to give you change. You’ll always have to enter your PIN.  
  

How much are the fees for running a card at a cashless ATM?

Depending on your bank, you can see a total minimum fee of $3.50 on average.  
 

Why can’t my dispensary accept credit cards?

Although cannabis is legal in the state of New Mexico, credit card companies are still hesitant to work with the cannabis industry because they consider it a “high risk.” This reluctance is also influenced by federal regulations surrounding cannabis and will most likely remain until it is federally legal in the United States.
